Release and Waiver of Liability and Indemnity Agreement

In consideration of being permitted to participate in any way in the Swimming Program indicated below, the parent(s) and/or legal guardian(s) of the minor participant named below agree:
1. The parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the Swimming activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate. I understand and agreed that, if at any time, I feel
anything to be UNSAFE, I will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.

 
2. I/WE fully understand and acknowledge that:
(a) There are risks and dangers associated with participation in Swimming events and activities that could result in bodily injury partial and/or total disability, paralysis, and death.
(b) The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe.
(c) These risks and dangers may be caused by the action, inaction, or negligence of the participant or the action, inaction or negligence of others, including, but not limited to, the Releasees named below.
(d) There may be other risks not known to us or are not reasonably foreseeable at his time.

 
3. I/WE accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis, or death, however, caused and whether caused in whole or in part by the negligence of the Releasees named below.
 
4. I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the facility used by the participant, including its owners, managers, promoters, lessees of premises used to conduct the Swimming event or program, premises, and event inspectors, underwriters, consultants, and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the facility or events held at the such facility and each of them, their directors, officers, agents, employees, all for the purposes herein referred to as “Releasee”...FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal
representatives assign, executors, heirs, and next to kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY, INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.

 
5. I/WE HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.
 
6. EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.
 
7. On behalf of the participant and individually, the undersigned partner(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release. If, despite this release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them harmless.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
Consent and Release Form

This document is a consent and release form that is allowing the named student below to appear in pictures for ads, newspapers, magazines, social media or any kind in representation of Nakamura Swimming and their marketing. I understand that my child will not be compensated for appearing in any media marketing of any kind and I will not expect any sort of discount, compensation nor monetary disbursement for it. I fully agree that Nakamura Swimming will only utilize any pictures of sorts with class and taste and for any promotional marketing to represent Nakamura Swimming or any of its affiliates.
Therefore, I am consenting for the allowance of taking pictures, videos, print, still shots for the release of marketing promotions, advertisement, showing on Facebook and other social medias and current events. 
Contract
​
1st. The PURPOSE of this contract is to provide SWIMMING CLASSES services, taking into account the physical conditions and motor skills of the STUDENT.
 
2nd. If you have a disease that imposes limitations on physical activity, the STUDENT must deliver to SWIMMING NAKAMURA a medical report informing such a condition. Failure to do so will be assumed to be in perfect physical condition, and SWIMMING NAKAMURA cannot, under any circumstances, be held responsible, directly or indirectly, legally or administratively, for any possible health problems that the STUDENT may have. have due to pre-existing illness.
 
3rd. SWIMMING NAKAMURA will provide the services at the chosen and previously established times. The student's tardiness will not be tolerated and, if it occurs, it will be deducted from the total of the class.
 
4th. In this service, there will only be replacement of classes in case of absences, due to illness where the STUDENT must prove by means of a medical certificate within 24 hours after the absence of the illness that was the reason for his/her absence.
 
5th- If SWIMMING NAKAMURA needs to reschedule the classes due to force majeure or health reasons, it must inform the STUDENT at least 12 hours in advance and it will replace the class according to a vacancy in the SWIMMING NAKAMURA agenda.
 
6th. The STUDENT who requests that the services provided by at their residence or at a different location established by SWIMMING NAKAMURA must provide means for the classes to take place in accordance with the requirements of SWIMMING NAKAMURA
 
7th. For the provision of contracted services, the STUDENT will pay SWIMMING NAKAMURA, the amount sent by the invoice due on the 1st (FIRST) day of each month.
Paragraph One – SWIMMING NAKAMURA will make an annual readjustment, agreed by both parties notifying at least 01 (one) month in advance.

 
8th. There will also be NO REFUND of amounts paid, unless for reasons of health duly proven by means of a medical certificate and report.
First Paragraph - In case the STUDENT is absent from classes due to travel/vacation and wishes to keep his/her place in the SWIMMING NAKAMURA agenda, the STUDENT must notify at least 30 (thirty) days and must pay a scheduled maintenance fee of 50% of the amount that would be paid for the period in question.

 

9th. In the event that the STUDENT cancels the lesson, they must be aware of the CANCELLATION POLICIES, adhering to the following conditions:

  • Cancellation with 12 hours' notice - No fee

  • Cancellation between 6 to 12 hours' notice - $30.00

  • Cancellation with less than 6 hours' notice - 100% of the lesson fee

10th. This agreement may be terminated by either party, with a prior notice of at least 15 (fifteen) days.

Clause 11. This contract shall be terminated automatically in the event of non-compliance with any of its clauses by the parties.

​

11th. This contract is of indefinite duration, starting from the date of its signing.
